Terms of service

1. Who you are contracting with
Phased (phased.studio, app.phased.studio) is operated by Ing. arch. Marko Rimár, a sole proprietor established in Slovakia.

In these terms, "we" and "us" means the provider named above; "you" means the person holding the account; the "privacy notice" means the notice at phased.studio/privacy, which forms part of these terms.
2. What Phased is
Phased is a single-person tool for tracking project time against budgets, seeing what that work is worth, and producing reports you can send to your clients. It is a record-keeping and reporting tool. It is deliberately not accounting, invoicing, or tax-filing software, it does not issue legally compliant invoices, and its numbers are not financial, legal, or tax advice. Keep your own books.
Phased is in public beta. The whole product is complete and in daily use, but expect the occasional rough edge, and expect details to keep changing while we learn from real use. Section 12 covers what that means for changes and availability.
A report keeps the figures it was generated with, and a complete export of everything you have entered is free on every plan at any time. You can of course delete your own content: deleting a report or your account removes it from the live service, with residual copies handled as the privacy notice explains. We take measures to protect your data, but cannot guarantee against every loss or interruption. Keep an independent copy of important records. If something is wrong or missing, please tell us at support@phased.studio or from Send feedback inside the app. A beta is only worth anything if the people using it say what is broken.
3. Your account
- You need to be 18 or older and give a real email address you control.
- An account is for one person. Phased has no seats, roles, or shared logins by design; don't hand your credentials to someone else.
- Keep your password to yourself and keep the devices you sign in from secure. Tell us at support@phased.studio if you think someone else got into your account.
- You are responsible for the content you put into your workspace and for having the right to store it.
- Phased is not built for sensitive personal data. Do not put special categories of personal data (GDPR Article 9: health, beliefs, sexual orientation, and the like) or criminal-conviction data (Article 10), whether about yourself or your clients, into the service without our prior written agreement, not even in a task name or a description.
4. Plans, trial, and price
- Free is free indefinitely, with no card and no time limit, within the limits shown on the pricing page.
- Your first account starts with a 30-day Pro trial. No card is required and it does not convert into a paid plan on its own. When the 30 days end, the workspace moves to Free unless you subscribe. Nothing is deleted.
- The trial is once per person, not once per sign-up. If you delete an account and register again with the same email address (or a variation of it) within two years, the original 30-day clock carries on rather than restarting, so a trial already used up stays used up. We keep only a one-way marker to recognise this, never the address itself, as described in the privacy notice.
- Pro costs €7 per month, or €66 per year (€5.50 a month, about 21% less). Prices are shown excluding VAT; VAT is added at checkout at the rate for your country.
- If you subscribe while your trial is still running, the paid plan starts and you are charged that day. Remaining trial days are not banked, refunded, or restarted.
- Founding price. Early subscribers keep the price they signed up at for as long as the subscription stays active and uninterrupted. Cancelling and re-subscribing later means the price current at that time.
5. Payment and who takes it
Payments are handled by Creem as our merchant of record. Creem is the seller of record for the transaction: it takes the payment, handles VAT (including B2B reverse charge where it applies), issues the billing document, and runs the billing portal where you can change your card, download receipts, or cancel. Creem, not Phased, is the name that appears on your card statement. We never see or store your full card details.
Completing a purchase also means accepting Creem's buyer terms for the payment itself; for the payment transaction, those terms take precedence over these.
You can open the billing portal any time from Settings inside the app.
6. Automatic renewal and cancellation
- A Pro subscription renews automatically at the end of each billing period (every month for monthly, every year for yearly) at the then-current price for your plan, until you cancel.
- You can cancel at any time, without giving a reason, from the billing portal in Settings. There is no notice period and no cancellation fee.
- Cancelling stops the next renewal. You keep Pro until the end of the period you already paid for; after that the workspace moves to Free. Deleting your account is the one exception: it ends the subscription immediately and gives up that remainder, as set out in section 11.
- Moving to Free never deletes anything, but the Free limits apply again. If more than three of your projects are active, you get seven days to choose which three stay active; after that we archive the rest for you, keeping the ones worked on most recently. Archived projects retain their data. You can reactivate them within your plan's active-project limit. Pro-only fields stop being editable, some money views and report branding are Pro, and your full export stays free on either plan.
7. Your 14-day right of withdrawal
This section is about the statutory right EU consumer law gives a consumer: a natural person subscribing outside their trade, business, or profession. Most people subscribe to Phased for their work, as a business, where this statutory right does not apply. The goodwill refund below is for any individual, whether or not they count as a consumer.
As a consumer in the EU you have 14 days from subscribing to withdraw from this contract, without giving a reason. Phased is a service supplied the moment you subscribe: by starting a paid subscription you expressly ask us to supply it right away instead of waiting out those 14 days. You make that request explicitly, by ticking the box on the upgrade page before checkout opens; we record it against the version of these terms you accepted. Asking for the early start does not end your right to withdraw. Its effect is smaller: if you withdraw after the service has started, the law lets a proportionate charge be kept for the part already supplied, and the rest is refunded.
In practice we are more generous than that: a first subscription period withdrawn in time is currently refunded in full, with the proportionate deduction waived. As a goodwill policy the same first-period refund is open on request to any individual subscribing for their work, a freelancer with a trade licence for example; it does not extend to companies. This is also why every account gets a full 30-day Pro trial with no card: you can use the whole product before any money moves.
To withdraw, use our online withdrawal form or send us an unambiguous statement within the 14 days. The online form lets you review and confirm your notice, then emails you a copy with its submission time. An email to support@phased.studio is enough and no particular form is required; you can use the model form below, but you do not have to. We, or Creem as our merchant of record, reimburse you within 14 days through the original payment method, and your Pro access ends.

Outside those 14 days, contact support@phased.studio about billing errors or a service that does not work as promised. We will investigate, correct billing errors and provide the remedies required by law, including a refund where due. Refunds are issued through Creem to the original payment method. None of this limits mandatory consumer rights you have under the law of your own country, including remedies for a service that is not what it was described to be.
8. Price changes
We may change the price of a plan. If a change affects your active subscription, we will tell you by email at least 30 days before it takes effect. If you do not want to pay the new price, cancel before the renewal it applies to; carrying on past that date counts as accepting it. Founding prices are covered by section 4.
9. If a payment fails
Card failures happen. Creem retries a failed renewal for a short period. If payment still does not go through, the subscription ends and the workspace moves to Free: Pro features lock, but nothing is deleted and you can subscribe again at any time. We do not send debt collectors after anyone over a €7 subscription.
10. Fair use
"Unlimited" on the pricing page means there is no plan limit, not that there is no ceiling at all. Very high service limits exist purely to keep automated abuse out and sit far above any real solo use. Don't resell or sublicense the service, don't try to break, overload, probe, or reverse engineer it, don't scrape it with automated tools, and don't use it to store anything illegal. Use it only as the law allows: not in breach of the laws that apply to you, and not in breach of sanctions or export-control rules.
Phased itself (the software, the design, the name) stays ours. These terms give you a personal, non-transferable right to use the service while your account exists, not a licence to copy any part of it, and they transfer no ownership in either direction: the product stays ours, and section 11 says the same about your content.
11. Your data
Your workspace content stays yours. You give us only the permission we need to run the service for you: to store, process, and display your content, and to render the documents you ask for. We do not sell it, share it for marketing, or use it to train anything. What we collect and who processes it is set out in the privacy notice, which forms part of these terms.
- Export: Settings → Your data gives you a complete JSON copy at any time, on Free as well as Pro. Restoring that file is subject to the destination account's plan limits; a backup containing Pro features may require Pro to restore.
- Deletion: Settings → Account deletes your account and its work data immediately from the live service. What can outlast deletion is exactly what the privacy notice lists: the one-way trial marker from section 4, statutory billing records where a subscription existed, and copies inside routine backups until those expire on their own short schedule. If you have a running Pro subscription, deleting the account cancels it with Creem first, straight away rather than at the end of the period. That means you give up the remainder of a period you have already paid for, and it is not refunded, so if you want to use the time you have paid for, cancel instead and delete the account once the period ends. Deleting an account is not itself a withdrawal request, and it does not affect your statutory rights or your eligibility under section 7. Write to us and we will deal with it. If the cancellation with Creem fails for any reason, nothing is deleted and your account is left intact so you can try again.
- Data processing agreement: the data processing agreement forms part of these terms and applies automatically whenever we process personal data in your workspace on your behalf, on Free, trial and Pro accounts. You do not need to request or separately sign it. A separately signed copy is available at no charge.
- Feedback: ideas and suggestions you send us about the product can be used freely to improve Phased, without obligation or payment. Your workspace content is never treated as feedback.
12. Availability, support, and changes to the product
- We aim to keep Phased available and working, and we monitor it, but we do not offer a guaranteed uptime figure. Planned maintenance is kept short and off peak hours where we can. We are not responsible for interruptions caused by events outside our reasonable control, such as an outage at a hosting provider, a failure in the networks between you and us, or a natural disaster, war, or government action.
- Support runs by email at support@phased.studio. Pro gets priority; we aim to answer within two business days. Phased is run by one person, so please read that as an honest target rather than a contractual response time.
- We may change features to improve security, fix defects, comply with law, maintain compatibility, or improve the service in response to use and feedback. Changes beyond those needed to keep the service conforming carry no additional charge. If a change materially reduces Pro, we will notify subscribers by email reasonably in advance, explaining what changes and when. If you end the affected subscription because of that reduction, we refund the unused prepaid period.
- If you are a consumer and a change negatively affects your access to or use of the service by more than a minor amount, you may terminate the affected contract without charge within 30 days after our notice or the change, whichever is later, with the refund required by law. This applies unless we let you keep the unchanged, conforming service without extra cost. Our advance email will explain this right.
- Phased is in public beta. Smaller changes and fixes are frequent, and defects or interruptions may occur. Beta and experimental labels describe development status; they do not exclude mandatory rights or the change-notice and refund commitments above.
- Keep your own backup of anything money-critical. Exports exist for exactly this. We take backups too, but a single-operator service is not a substitute for your own records.
13. Liability
Phased is provided as it is and as available, with the quality you can reasonably expect from a small, actively maintained product. The following financial cap and loss exclusions apply to business customers only, to the extent the law allows, our total liability to you for any claim connected with the service is limited to the subscription fees you paid for Phased, including through Creem, in the 12 months before the claim arose, or to €50 if you have not paid subscription fees in that time. We are not liable for indirect or consequential loss, for lost profit, or for business decisions you make based on numbers in the app.
Nothing here limits liability for death or personal injury, for intentional harm or gross negligence, for fraud, or for anything else that cannot be limited by law, including mandatory consumer remedies and data subjects’ rights to compensation under GDPR. A beta label does not remove these rights.
14. Suspension and termination
You can stop using Phased whenever you like, by cancelling and, if you want, deleting your account. We may suspend or close an account that breaks these terms, that is being used to harm the service or other people, or where we are required to by law. Except in clear abuse, we will contact you first and give you at least 30 days to export your data before the account closes.
15. The legal odds and ends
- Transfer: your account is personal and cannot be transferred or sold. We may transfer this agreement as part of a sale or reorganisation of the business; your rights under it carry over unchanged, and you can always cancel if you would rather leave.
- Severability: if a clause of these terms turns out to be invalid, the rest stays in force, where the agreement can continue without it. Mandatory rules on unfair consumer terms remain unaffected.
- Entire agreement: these terms, the privacy notice, and the pricing page you subscribed under are the whole agreement between us. Nobody has authority to promise you something else on our behalf.
- No waiver: if we do not enforce a clause for a while, we have not given it up.
16. Changes to these terms
We may update these terms as the product and the law change. The "last updated" date at the top always reflects the current version, and earlier versions are available from us on request. For changes that materially affect your rights or what you pay, we will notify affected account holders by email at least 30 days in advance, explaining the change and their options. We will obtain agreement where the law requires it; continued use does not waive mandatory rights. If you reject a material adverse change, you may end the affected service before it takes effect and receive a refund of unused prepaid time.
17. Governing law and disputes
These terms are governed by the law of Slovakia, and the courts of Slovakia have jurisdiction, except that if you are a consumer, you keep the protection of the mandatory rules of your own country of residence and may bring proceedings in its courts.
Please write to us first: nearly everything is solved by an email. Consumers in Slovakia may also approach the alternative dispute resolution body listed in section 19. Consumers elsewhere in the EU can use their own national ADR body.
